Mechanic's Lien
Privately-owned real estate and IDA jobs
Last Day to File Mechanic's Lien:
    Residential 4 mos. from last labor/material
    Commercial 8 mos. from last labor/material
Date Lien Expires: One year from date of filing
Date Lien Extension Expires: One year from date of filing of extension (lien on single-family residence cannot be extended).
Public Improvement Lien
(State, County, Town, Village, School District and other public jobs)
Last Day to File Public Improvement Lien: Within 30 days after acceptance and completion by municipality
Date Lien Expires: 6 mos. after filing
Date Lien Extension Expires: 1 year from date of filing extension
Labor and Material Payment Bond Claims
Notice to Contractor:
If you have a contract with Subcontractor
90 days* from date of last labor/material (AlA Bond)
120 days from date of last labor/material* (§ 137 of State Finance Law)
Last Day to Sue Surety: 1 year from date on which final payment on subcontract became due
1 year from date of last labor/material (Federal Job - Miller Act)
